About Lawyer Disciplinary Board

The Office of Lawyer Disciplinary Counsel (ODC) functions as the investigative and prosecuting authority for violations of the Rules of Professional Conduct in West Virginia. The Lawyer Disciplinary Board (LDB) serves as the governing body for the ODC, comprising twenty-two members, including fifteen lawyers and seven lay persons.

The ODC provides ethics advice to attorneys on their ethical responsibilities. The Lawyer Disciplinary Board issues advisory opinions concerning the ethical conduct of attorneys, with an archive of these Legal Ethics Opinions available by chronological order or subject matter. While these opinions are generally advisory, those issued under Rule 2.16 of the Rules of Lawyer Disciplinary Procedure are binding upon the Hearing Panel of the Lawyer Disciplinary Board in subsequent disciplinary proceedings involving the requesting lawyer.

The ODC also disseminates information regarding disciplinary decisions and amendments to the Rules of Lawyer Disciplinary Procedure. The organization's website offers resources such as a complaint packet for filing grievances against attorneys, a handbook for court-appointed trustees, guidelines for closing a law practice, and a client trust account handbook. The ODC aims to ensure timely and accurate public information regarding lawyer discipline and professional conduct.

People who work at McDonald's and Wal-Mart have a higher ethical code than WV attorneys!! The other reviewer on here is completely correct. This disciplinary board allows attorneys to violate ANY and all codes of conduct. They told me that an attorney lying in court and misappropriating state and federal funds was okay because she was simply being aggressive! Ha HA! This committee is a name sake in order to lie to the citizens so that we think there is some kind of oversight. This is just a board of elite criminals covering for other elite criminals, and a total waste of tax payer funds. I tell my children and all young people, keep your soul and DO NOT BECOME a LAWYER / LIAR!!

They've denied me my files on the complaint I've submitted to them on Greg Michaels. He literally didn't reply back to my complaints within the allotted time frame, only for them to tell me when I called, that they'd call him and get him to reply. So now both Greg Michael's and the board have committed ethical violations. WV judicial system is nothing but corruption from top to bottom. The bar members cover for bar members. 💯

Reported documented fraud charges as well as documented proof overriding ethical and legal instructions without authorization that were dismissed due to Rule 2.1(a) meaning any decision the attorney makes can later be characterized as involving "professional judgment". So what this means is if you hire an attorney in West Virginia, you have surrendered your right to determine: whether to contest or consent to legal proceedings; The fundamental objectives of your representation. This Board only exists to whitewash the criminal behavior of lawyers.

One star is far far far too many . Reporting to higher levels .. So let me get this straight ,I reported a lawyer for very reasonable suspicion of violating Federal law related to blocking some access to some of my medical records etc and I get a letter closing the complaint ? No investigation? Ha what exactly is their job then ? Where is the accountability? I will report to every Federal agency that will take my complaint

I am extremely disappointed with my experience with this office. I submitted what I believed to be a well-founded complaint against a prosecutor and was frustrated to learn that no investigation would be pursued. From my perspective, the process lacked transparency and accountability. The decision left me with the impression that complaints against attorneys, particularly government attorneys, face a very high barrier to meaningful review. I was not convinced that my concerns received the level of scrutiny they deserved. The legal profession depends on public trust, and that trust requires an oversight system that is willing to thoroughly investigate allegations of misconduct regardless of who is involved. In my case, the outcome gave me little confidence that the disciplinary process is effective at holding attorneys accountable. While others may have different experiences, my experience left me feeling that the system is more focused on protecting members of the profession than addressing complaints from the public. Because of that, I cannot recommend this office to anyone expecting transparency, independence, or accountability Yet another corrupt entity in wv making our state a corrupt state.
