State Attorney

The Brown County State's Attorney's Office serves the residents of Brown County and the State of South Dakota. Its primary role involves acting as the chief prosecutor for adult and juvenile crimes within Brown County. The office also undertakes the responsibility of protecting children residing in abusive or neglectful environments.

Beyond prosecution, the State's Attorney's Office provides legal counsel and representation to the Brown County Board of Commissioners, as well as other elected and appointed county officials and department heads. The team comprises five attorneys, four legal assistants, and a victim specialist, collaborating with law enforcement to maintain public safety and a low crime rate in northeast South Dakota.

The office manages several specialized programs designed to address specific community needs. The Juvenile Diversion program offers an alternative to formal juvenile court proceedings, aiming to educate young offenders on consequences and equip them with tools for better decision-making. Successful completion of this program can lead to the dismissal of charges. Additionally, the Brown County Drug & DUI Court provides an innovative approach to rehabilitation for individuals impacted by substance use or mental health disorders who are likely to commit crimes without intervention. This court partners treatment providers with probation, defense, prosecution, law enforcement, and the judiciary to deliver personalized, evidence-based treatment and recovery services.

Victim Assistance is another key service, with a dedicated specialist located within the office. This department helps victims navigate the criminal justice system, from arrest through prosecution, by providing notifications, explaining legal processes, assisting with compensation applications, and referring victims to community support services. Services cover various crimes, including violence, domestic violence, stalking, and certain assaults.
