State Attorney

The Burleigh County State's Attorney's Office serves as the chief prosecuting officer for Burleigh County, North Dakota, and acts as the legal advisor for all county officials. The office is responsible for handling a range of legal matters that occur within Burleigh County. These include felony, misdemeanor, infraction, and traffic cases. Additionally, the State's Attorney's Office addresses juvenile court matters and mental health hearings.

The office's functions are distinct from private legal practice. State law prohibits the State's Attorney from providing advice on private matters, and civil cases are directed to private attorneys. The Burleigh County State's Attorney's Office does not conduct criminal investigations; instead, it reviews matters after investigations are completed by appropriate law enforcement agencies to determine whether criminal charges will be filed. The office maintains a team of attorneys, including a State's Attorney, Senior Attorneys, and Assistant State's Attorneys, to fulfill its duties. Victim/Witness Coordinators are also part of the team to assist individuals involved in cases.
