My attorney Whitney Kalinowski gave me misinformation about my case and trial for over a year. I was told multiple times on record things that were not factual. I have all the proof necessary.

⭐ 1 star No prosecutor should be allowed to rewrite the law by ignoring half the statute. Community Message Against Erica Marthage's Re-Election Erica Marthage has been the Bennington County State's Attorney since 2007. Over that time, she has repeatedly shown that she either does not understand, or refuses to follow, the plain language of Vermont's laws. She misclassified 13 V.S.A. § 3002 (Impersonation of a Public Officer) as a predicate offense, blocking lawful expungements — even though the statute itself proves otherwise. She is on the Brady List, which means courts and defense attorneys have been formally warned that her credibility is compromised. In a 2018 GNAT-TV interview, she admitted on record: "It's not my job to make the law, it's only my job to enforce however it comes out of the Legislature." Yet in practice, she has done the opposite — stretching and rewriting statutes by speculation instead of enforcing them as written. Her office has wasted time and resources prosecuting weak or misclassified cases instead of focusing on serious crime and public safety. The people of Bennington County deserve a State's Attorney who respects the statute as written, applies the law fairly, and restores public confidence in the justice system. That's why I am committed to doing everything in my power to ensure Erica Marthage is not re-elected. A suitable candidate is ready to step up — one who knows how to read and apply statutory law, and who will lead with integrity and fairness. Summary of the Issue: In 2013, I was charged with impersonation of a public officer under 13 V.S.A. § 3002. This is a misdemeanor. Years later, when I asked the court to clear my record, the State argued it was a "predicate offense" (a special category of crimes used to increase penalties in future cases). The Problem: The law is crystal clear: only DUI, domestic assault, and stalking are predicate offenses under Vermont law (13 V.S.A. § 7601(3)). Impersonation of a public office
