Exceptions and details
Small Claims is a section of the Superior Court, Law Division, Special Civil Part. Limit is $5,000, and tenant security-deposit return claims are also capped at $5,000 in small claims. Claims over $5,000 and up to $20,000 are filed in the regular Special Civil Part. Current limits come from the Supreme Court's 2022 order amending R. 6:1-1 and 6:1-2 (effective July 1, 2022; general small-claims limit rose from $3,000).
Same section has a special rule for birth-injury medical malpractice claims by minors (must be filed before the minor's 13th birthday). Other claim types (e.g. sexual abuse) have separate statutes.
NJSBA does not operate a statewide LRS; its page lists the county bar associations that run lawyer referral services and asks users to contact the service in their own county.
